Terms of Service

These terms are an agreement between you and Md Mahabubur Rahman, trading as Tulx ("we", "us"), for your use of the Nayan app and any related services. By installing or using Nayan you agree to them. If you do not agree, do not use the app.

1. What Nayan is

Nayan is a document scanning and text recognition app. It photographs or reads pages through your camera, recognises the text on the device, keeps a searchable library, and exports files in several formats. Optional account features add cloud backup, sync, and higher-accuracy recognition through our servers.

2. Your content

Everything you scan, import, recognise or export with Nayan is yours. We claim no ownership of it. When you use account features, you grant us only the limited permission needed to store, transmit and process that content for the purpose of providing the feature you asked for, and for no other purpose.

You are responsible for making sure you have the right to scan and store the material you use with Nayan. Do not use the app to copy material in a way that infringes someone else's copyright or privacy.

3. Accounts

You do not need an account to use Nayan. If you create one, you must give accurate information, keep your credentials secure, and be at least 13 years old. You are responsible for activity under your account. You can delete your account at any time; see Delete your account.

4. Fair use limits

Guest users may export a limited number of files per day; account holders are unlimited. Cloud features are subject to reasonable storage and request limits to keep the service available for everyone. We may adjust these limits and will show the current ones in the app.

5. Acceptable use

You agree not to:

• use Nayan for anything unlawful, or to scan and distribute material you have no right to;
• attempt to access other users' accounts or data, or to probe, disrupt or overload our servers;
• reverse engineer the cloud services, or use them from software other than Nayan without our written permission;
• resell the cloud services.

6. Recognition accuracy

Optical character recognition is not perfect. Nayan marks text it is unsure about, but recognised text may still contain errors, particularly on handwriting, poor lighting, unusual fonts or curved pages. Check any recognised text before relying on it for anything important, such as legal, financial or medical documents.

7. Guest data lives on your device

In Guest mode your library is stored only on your phone. If you uninstall the app, clear its storage, lose the device or it is reset, that data cannot be recovered by us or anyone else. The app tells you this before you continue as a Guest. Creating an account and backing up is the only way to keep a copy elsewhere.

8. Third-party components

Nayan includes open-source software (including Tesseract OCR, Leptonica, SQLite and the Flutter framework) and Google ML Kit, each under its own licence. Those licences are listed inside the app. Language packs downloaded for Bengali and Arabic are provided by the Tesseract OCR project under the Apache 2.0 licence.

9. Changes to the service

We may add, change or remove features, and we may update the app to keep it working with new versions of Android. If we discontinue the cloud services we will give account holders at least 30 days' notice and a way to export their library. The on-device features of the app continue to work without the cloud.

10. Disclaimer and limitation of liability

Nayan is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose. To the fullest extent permitted by law, we are not liable for any indirect, incidental or consequential loss, including loss of data or of recognised text, arising from your use of the app. Nothing in these terms limits liability that cannot be limited by law.

11. Termination

You may stop using Nayan at any time by uninstalling it and, if you have one, deleting your account. We may suspend or close an account that breaches these terms. Sections 2, 10 and 12 survive termination.

12. Governing law

These terms are governed by the laws of Bangladesh. If you live in a country whose consumer protection laws give you additional rights, those rights are not affected.

13. Changes to these terms

We may update these terms. The effective date at the top will change, and for significant changes we will tell you inside the app. Continuing to use Nayan after a change means you accept the new terms.
